Accused denied bail

A 25-YEAR-OLD man from Siparia was denied bail yesterday by a San Fernando magistrate before whom the man appeared charged for a robbery on Wednesday.

Andre Modesto of Pierre Street, Robert Village, appeared before senior magistrate Jo-Anne Connor who read a charge that at about 2 pm, Modesto held up Sookram Boodram at Wellington Road, Debe. Boodram was robbed f his car valued $45,000, a driver’s permit, ID card, bank card, insurance policy and $2,000.

Cpl Neil Nanan of the Barrackpore CID investigated the incident and arrested Modesto. Police prosecutor Cleyon Seedan, told Connor that Modesto has a similar case pending in the Siparia court. Regarding other cases, Modesto told the magistrate that he won a case for robbery with aggravation in 2017. He served four months in jail for another offence, he admitted.

He told the court that the case pending in Siparia is due to begin on Monday. Seedan submitted that the Bail Act stipulates that a person charged with an offence but who is on bail for another offence of a similar nature, cannot access bail except before a judge in chambers.

Seedan handed Modesto a copy of the summary of evidence in the case of Rampersad’s stolen items and Connor remanded Modesto into custody until next Monday. Modesto was told to produce the court extracts for his previous criminal record.
