Hung jury in Marabella murder trial

A 12-member jury that heard evidence in the murder trial against Randy Flemming and Okechukwu Moyo was unable to reach a unanimous decision in the March 12, 2009 murder of Jason Fullerton. A retrial was ordered on Wednesday in the case heard before Justice Maria Wilson in the San Fernando Third Criminal Court after jury members deliberated for over three hours.

Flemming, 42, and Moyo, 23, are charged with murdering Fullerton of Jack Street, Marabella, at about midnight at a track off Ramsamooj Trace, Marabella. Wilson heard that Fullerton’s friend Alicia McKenzie was at a bar when Flemming, whom she had known for the past two months, spoke to her. During the conversation, Flemming allegedly threatened to kill Fullerton.

A few minutes before the killing, McKenzie went to meet Fullerton at Ramsamooj Street, Marabella. She waited near a river where there was a bridge and a track and saw people by a house, including Flemming and Moyo. The State’s case is that McKenzie saw Fullerton coming out of the track and took a gun from his waist, passed it to Flemming and then to Moyo, who shot Fullerton. Fullerton was allegedly also shot by another person.

The State’s case was led by senior state attorney Trevor Jones, instructed by state attorney Anslem Leader, who led evidence from several witnesses. A statement given to the police by McKenzie, who said she saw what happened, was also tendered into evidence. McKenzie, the court heard, was found dead a month after Fullerton’s killing.

Senior Counsel Pamela Elder represented Moyo while Flemming was defended by attorney Kevin Ratiram, instructed by attorney Kiran Panday.
